Poughkeepsie Bankruptcy Litigation Attorney

Most bankruptcy cases proceed as expected. When debtors and their lawyers appear before a bankruptcy court-appointed trustee for the 341 creditors' meeting, creditors almost never appear. Most creditors realize that they have no choice but to accept the bankruptcy and therefore do not spend time and energy fighting it.

Sometimes, however, disputes and conflicts arise. Genova & Malin, Attorneys at Law, most often represents debtors in bankruptcy cases. At the same time, where there is no conflict of interest, we represent creditors in litigation and defend their rights before trustees and judges of the bankruptcy court.

Out of several dozen lawyers in the Hudson Valley doing bankruptcy, it is our observation and impression that few if any of the others have actually been inside a bankruptcy courtroom. Most of them only attend 341 creditors' meetings, which are not held in a courtroom. In bankruptcy litigation cases, however, we represent our clients (who are creditors) in bankruptcy court. We also engage in trustee litigation matters.

With our years of experience helping clients file bankruptcy and attorney Thomas Genova's experience as a bankruptcy trustee, we have uncommonly in-depth knowledge to put to work on behalf of our creditor clients in bankruptcy litigation matters.

Rules of bankruptcy court are complex. Timing is critical. We have the knowledge and experience necessary to represent creditors aggressively and effectively in adversarial proceedings. Our record of success in this area of our bankruptcy law practice is beneficial to our many debtor clients, as well. We know how to keep them out of adversarial proceedings.
